Terms of Use

1. Terms

By accessing this School (Find Your Center), you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.



2. Private Session Policies

a. Availability

You are responsible for viewing the provided availability calendar or contacting Find Your Center to check availability before purchasing a private session. In the event that you and your instructor cannot find a mutually agreeable time within your purchase period (within the month for monthly sessions, or within the expiration period for one-time purchases), you will be offered one of the following remedies: 1) An extended time period for scheduling your private session; 2) A coupon for the value of the session, to be used for other Find Your Center products or services.


b. Rescheduling

You may reschedule a private session by contacting Find Your Center to cancel no later than 24 hours before your scheduled and confirmed time. Private sessions must be rescheduled within the purchase time period. Find Your Center may reschedule a private session by contacting you to cancel no later than 24 hours before your scheduled and confirmed time. In the event that a session cancelled by Find Your Center cannot be rescheduled within the purchase time period, you may choose to reschedule for a later date or request a credit or refund.


c. Attendance

Your instructor will be available to you in the virtual meeting room during the entire duration of your scheduled and confirmed private session. If you arrive late or miss the session, you will not be refunded.



3. Group Session Policies

a. Schedule

You are responsible for viewing the published class schedule before making a purchase, and for purchasing a number of class hours that works for your schedule. If you do not attend the full number of hours that you have purchased before they expire, you will not be refunded. Find Your Center will contact you if any changes are made to the published schedule after your purchase. In the event that the revised schedule no longer works for you, you will be offered one of the following remedies: 1) An extended time period for using your purchased hours; 2) A coupon for the value of your purchase, to be used for other Find Your Center products or services.


b. Attendance

In the event that no students show up to a scheduled group class, the instructor may close the virtual meeting room after 15 minutes.


c. Hours and Expiration

You may contact Find Your Center at any time to verify how many hours you have purchased, which classes you have attended, how many unused hours you have remaining and when they expire.



4. Assumption of Risk

a. Physical Injury

As an adult student or a parent/guardian of a student under 18, you acknowledge that there are risks of physical injury associated with, arising out of, and inherent to the activities of dance, martial arts, and fitness. You understand that when you/your student takes classes online, you are responsible for creating a safe space and for positioning your camera and microphone so that the instructor can provide feedback on how to perform exercises safely. You are also responsible for following instructor recommendations and for communicating with your instructor if you are experiencing pain or have any doubts about how to perform the given movements safely. You understand that in-person training (when available) involves touching and adjustment of the student's body by the instructor. On your own behalf, or on behalf of your child, you voluntarily assume this risk. You release and hold harmless Find Your Center and its staff from any liability, claims, demands, and causes of action arising out of or related to any loss, damage, or injury that may be sustained by the student during Find Your Center activities, unless said loss, damage, or injury is a direct result of gross negligence by Find Your Center staff. If you are a parent/guardian of a student under 18 participating in an in-person activity, in the event that you cannot be reached, you hereby grant permission to Find Your Center staff to authorize any emergency medical care that may be required by the student during participation in Find Your Center's in-person activities. You understand that youare responsible for any and all charges that result from such care or medical treatment.


b. Privacy

You acknowledge that your use of a camera and microphone during live online sessions constitutes consent for instructors, classmates, and anyone who is present in their homes to see and hear the space in which you are training. You understand that you are responsible for communicating with your instructor and turning off your camera and/or microphone if you do not wish to be seen or heard.


c. Security

You acknowledge that online classes are subject to security risks that extend beyond the control of Find Your Center. You are responsible for the security of your internet connection and your devices. In the event that Find Your Center staff are disconnected from a live online meeting, you are responsible for terminating your own connection if you so choose. On your own behalf, or on behalf of your child, you voluntarily assume this risk. You release and hold harmless Find Your Center and its staff from any liability, claims, demands, and causes of action arising out of or related to any security breach that may occur during Find Your Center activities, unless said breach is a direct result of gross negligence by Find Your Center staff.



5. Use License

Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on the School’s web site;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or 'mirror' the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.



6. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.



7. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.



8. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.



10. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.



11. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction (California, USA) without regard to its conflict of law provisions.
